Winclap Technology LLC (“Winclap”), a global growth transformation company, has acquired the Brkaway platform (the “Platform”) and related assets from Brkaway Media Inc. (“Brkaway”). This transaction, effective December 10, 2025, will support continued innovation in the services, including the Platform (the “Services”) you rely on.

What this mean for you

No disruption 

Your access, data, features, pricing, and subscription remain unchanged. There will be no interruption in service. 

Material changes to Legacy Package Brands Terms of Service

To align with its operations and standard practices, Winclap is making material updates to the Legacy Package Brands Terms of Service, effective January 23, 2026.

The key material changes are:

• Winclap Technology LLC is the new service provider, along with updated contacts and notice addresses.

• Governing law: Changing from the laws of the Province of Ontario and the federal laws of Canada to the laws of the State of New York, United States (without regard to conflict of laws principles). 

• Jurisdiction: Changing to the state and federal courts located in New York County, New York, for resolution of disputes (exclusive jurisdiction).

• Waiver of jury trial: Adding a provision under which both parties waive the right to a jury trial in any dispute, meaning disputes will be decided by a judge (bench trial).

• Indemnification: Including the Subscriber’s obligation to indemnify Winclap for losses arising from the Subscriber’s breach of the agreement or failure to comply with applicable laws.
